Personal Data Protection Policy

Services Du Numérique NAPARTY inc., a company incorporated under the laws of Quebec registered with the Registraire des Entreprises du Québec under number (NEQ) 1174429754, located at 4020 Croissant Bazin, Brossard, Quebec J4Z2J4 (hereinafter "NDS") processes personal data (as defined below) in the course of its activity, which includes the personal data of individuals who browse NDS's websites (the "Sites").
The purpose of this "Personal Data Protection Policy" (the "Policy") is to inform all natural persons concerned ("You" or "Your") about how NDS collects and uses such personal data and about the means available to You to control such use.
​1. Scope of this personal data protection policy
This Policy sets out the principles and guidelines applicable to the protection of Your personal data, which includes personal data collected on or through the Sites.
NDS collects personal data online (including by email) or offline; this Policy applies regardless of the method of collection or processing.

Personal data ("personal data") means any information relating to an identified or identifiable natural person. A person is "identifiable" if he or she can be identified, directly or indirectly, in particular by reference to an identification number or to one or more elements specific to him/her.

"Non-personal data" is information that does not identify an individual.
Each Site is subject to specific Terms of Use available on each Site and which form part of this Policy. Your use of the Sites and the personal data that You agree to communicate on the Sites are subject to the provisions of this Policy and the applicable Terms of Use.

2. Data collected
Visitors are individuals who visit the Sites without making any registration. Their personal data may include:

Users are individuals who visit the Sites and record information. The personal data collected for the purposes set out below may include the following:

The personal data collected, however, will be limited to the data necessary for the purposes set out in section 4 below.
Certain functionalities and features of the Site may only be used if You provide NDS with certain personal data when You visit or use the Site. You are free to provide or not provide all or part of Your personal data. However, if You choose not to provide them, such a decision may prevent the achievement or satisfactory achievement of the purposes described in Section 4 below, certain services and features of the Sites may not function properly and/or You may be denied access to certain pages of the Site. In particular, You will not be permitted to submit an application or purchase any services through the Site.

3. Protection of children's personal data
The NDS Services are not intended to be marketed to children who are considered minors under data protection law and NDS does not voluntarily collect or maintain personal data from children.
If parents discover that their child has provided personal data to NDS without their consent, they may request that NDS delete such personal data and terminate the child's account by sending an email to NDS's Data Protection Officer using the following email: compliancy@nds-solutions.io
If it becomes known to NDS that personal data of children is nevertheless collected, NDS will take the necessary steps to delete such personal data and the child's account.

4. Purposes and legal bases for the collection of personal data
Whether You are a visitor or a user, NDS collects personal data about You in accordance with the following legal bases and purposes:

Acknowledge that You have provided personal data so that You do not need to do so for every web page requested;

Enable NDS to manage investigations.
In addition, in Your capacity as a user, NDS collects Your personal data pursuant to the legal bases and for the following purposes:

To allow you to request and obtain information about NDS and the services of NDS or a third party designated by NDS for this purpose;

To identify Your needs and interests and provide You with the most appropriate services;

To enable NDS to manage its marketing activities;

NDS may provide certain strictly necessary personal data such as a user ID in hashed form to social networks operated by third parties or to other web offerings (such as Linkedin, Facebook, X, Whatsapp or Google) where this information is compared to the social networks' own databases in order to allow You to have access to the most relevant information.
- Processing based on NDS's legitimate interests:

To allow NDS to manage its marketing activities for similar services if You are already using NDS services;

Manage NDS's obligations relating to applicable export laws, trade sanctions and embargoes issued by the European Union and its Member States, and the United States of America, among others. This may include (i) automated checks of all user registration data as set forth in this Policy and other information You provide about Your identity against sanctioned lists; (ii) regular checks whenever a list is updated or when You update Your information; (iii) blocking access to NDS services and systems in the event of a potential match; and (iv) Contact You to confirm Your identity in the event of a potential match;
- Processing based on the performance of a contract:

To allow you an interactive and personalized use of the Sites;

To allow you to open and manage an account in order to obtain specialized documentation and assistance;

Access all the features and options offered by the Sites;

To allow you to interact with other users of the Sites;

To enable NDS to manage its business relationships, including business opportunities, business offers, purchases, contracts, orders, invoices, which may include conversational data triggered via chat features on the Sites, contact forms, emails, and voicemail data;

To provide you with commercial or support services;

To allow you to purchase services, download documents;

Manage Your training and/or certification on NDS services.

Where consent is not required, You may not opt-out of non-marketing-related communications in connection with NDS's business. With respect to marketing-related communications (e.g., emails and phone calls), NDS will only (i) send You such communications after obtaining Your Consent, if required by applicable law, and (ii) provide You with an opportunity to opt-out of receiving such marketing communications from NDS.
When You register for an event hosted by NDS, NDS may share Your name, company name, and email address with other attendees and sponsors of the same event for the purposes of communication and exchange of ideas. In addition, NDS may request information from You about Your health condition for the sole purpose of identifying and being attentive to people with disabilities or special dietary needs throughout the event.
Subject to applicable local law, by providing Your personal data such as Your email address, You expressly authorize NDS to use it together with other personal data useful to send You commercial or marketing messages. NDS may also use Your e-mail address for administrative or other non-marketing purposes (e.g., to notify You of important changes to the Sites).

5. Retention period of personal data
NDS does not store Your personal data for longer than necessary. Retention periods may vary depending on the categories of data and processing.
Where NDS processes and uses Your personal data in accordance with the law or with Your consent, NDS will retain Your personal data (i) only for the reasonable time required to achieve the purposes set out above, (ii) in cases where NDS has a legitimate interest in using Your personal data, until You object to the use of Your personal data, or (iii) where You have given Your consent, until You withdraw it. However, where NDS is required by law to retain Your personal data for a longer period of time or where Your personal data is required to assert or defend against legal claims, NDS will retain Your personal data until the end of the relevant retention period or until such claims are finally decided.

6. Transfer of personal data
If You are accessing the Sites from a location outside of Quebec, whose laws or regulations govern the collection, use and disclosure of data different from those in Quebec, please note that through Your continued use of the Sites governed by Quebec law, the corresponding terms of use and this Policy, You are transferring Your personal data to Quebec and You consent to such transfer.

7. Right of access, rectification and other rights
NDS has put in place appropriate personal data protection mechanisms to ensure that personal data is used in accordance with the above purposes and to ensure that it is accurate and up to date.
You have the right to access Your personal data. In addition, You have the right to request the rectification, updating or deletion of Your personal data. You have the right to restrict processing. You also have the right to obtain the communication of Your personal data stored by NDS. You have the right to object to specific processing of Your personal data. In addition, You may have a right to data portability.
If You have an account, You may exercise Your rights of access and rectification by logging into Your account. Alternatively, You may exercise Your rights by sending an email to the following address: compliancy@nds-solutions.io
Depending on the scope of the request, NDS reserves the right to charge the requester a reasonable amount to cover the costs of accessing, rectification or deletion operations. NDS reserves the right to refuse access to personal data in the particular cases provided for by applicable laws and regulations.

8. Recipients of the data
If NDS becomes aware that a third party to whom NDS has provided personal data for the purposes listed in Section 4 above, is using or disclosing personal data in violation of this Policy or applicable laws, NDS will take reasonable steps to prevent or stop such use or disclosure. NDS may disclose Your personal data to third parties if NDS determines that such disclosure is necessary for technical reasons (such as hosting services by a third party) or to protect NDS's interests (for example, in the event of a sale of assets to a third party, or a change in control or total or partial liquidation of NDS).
NDS may also share Your personal data with business partners when NDS and the business partner jointly sponsor an event or participate together in a marketing promotion in which You engage.
NDS may disclose Your personal data if required to do so by law or if NDS believes in good faith that such disclosure is reasonably necessary to comply with legal process (e.g., a warrant, subpoena, or other court order) or to protect NDS's rights, property, or personal safety, of our customers or the public.
If permitted by applicable law, NDS may also share Your personal data with third parties in order to provide You with targeted marketing or advertising offers.

9. Security
NDS takes care to protect and secure the personal data that You have chosen to communicate to it, to ensure its confidentiality and prevent it from being distorted, damaged, destroyed or disclosed to unauthorized third parties.
NDS has taken physical, electronic and organizational protection measures to prevent any loss, misuse, unauthorized access or dissemination, alteration or possible destruction of such personal data. However, despite NDS's efforts to protect Your personal data, NDS cannot guarantee the infallibility of such protection due to unavoidable risks that may arise during the transmission of personal data.
As all personal data is confidential, access to it is limited to NDS employees, service providers and agents who need it in the context of the performance of their mission. All persons with access to Your personal data are bound by an obligation of confidentiality and may be subject to disciplinary measures and/or other sanctions if they fail to comply with these obligations.
However, it is important that You exercise caution to prevent unauthorized access to Your personal data. You are responsible for maintaining the confidentiality of Your password and the information contained in Your account. Therefore, You must ensure that You log out if you are using the same computer on a shared basis.

10. Cookies
The Sites may use cookies or other similar technologies or technologies with the same purpose (hereinafter referred to as "cookies") that may collect or store personal data. Cookies are text files stored and used to record personal and non-personal data about Your browsing on the Sites. Cookies may be persistent (and remain after You log out of the Sites in order to be used on subsequent visits to the Sites) or temporary (and disappear as soon as You log out of an Internet browser).
NDS uses cookies in order to:

NDS may also use the services of third-party providers (such as Wix, Google Analytics, etc.) to perform the services on its behalf and in particular to:

Analyze Your browsing habits and measure the audience of the Sites,

Analyze Your interests and provide You with targeted marketing or advertising offers,

To allow you to share content from the Sites with others on social media or to let those others know what You are watching or thinking (e.g., the "Like" button on Facebook)
In this case, cookies provided by these third-party providers may be used and stored. When transmitting the information generated by these cookies, the cookie settings ensure that the IP address is anonymised before geolocation and before storage. Our vendors will use this information for the purposes of evaluating Your use of the Sites, compiling reports on Site activity for NDS, and providing You with better services and advertising targeted to You. They will not associate Your IP address with any other of their data.
When You browse the Sites, cookies are enabled by default and data may be read or stored locally on Your hardware. You will be notified the first time You receive a cookie and You can decide whether to accept or reject it. By continuing to use the Sites, You expressly agree to NDS's use of such cookies. You can also set Your browser to always refuse cookies (including cookies used for audience measurement purposes). However, if this is the case, certain features and functionality of the Sites may not function properly and You may not be able to access certain parts or services of the Sites.

11. Links to websites not controlled by NDS
The Sites may provide links to third-party websites that may be of interest to You.
NDS has no control over the content of third-party sites or the practices of such third parties with respect to the protection of personal data that they may collect. As a result, NDS declines any responsibility for the processing of Your personal data by these third parties. It is Your responsibility to inform yourself about the personal data protection policies of these third parties.

12. Conflict Resolution
Although NDS has taken reasonable steps to protect personal data, no transmission or storage technology is completely foolproof.
However, NDS is concerned about ensuring the protection of personal data. If You have reason to believe that the security of Your personal data has been compromised or misused, You should contact NDS's Data Protection Officer at the following address: compliance-privacy@sdn-naparty.com.
NDS will investigate complaints regarding the use and disclosure of personal data and attempt to resolve them in accordance with the principles set forth in this Policy.
Unauthorized access to or misuse of personal data may be an offence under local law.
